These General Terms and Conditions of Sale (hereinafter referred to as the "Terms") govern, without exception or reservation, all transactions for Services offered on the Site. https://cnvrt1.com/ (hereinafter referred to as the "Site"). They define the commitments of JMM PUBLISHING LTD (hereinafter the "Seller") and those of the Customer (hereinafter the "Customer"). The Conditions may be consulted on the Site where they are freely accessible to any User.
All Customers and Users acknowledge that they have accepted these Terms and Conditions by placing an order. They declare that they have examined the Conditions prior to any transaction. The currently published version of the Terms prevails for all Customers and Users of the Site:
These Conditions remain in force until modified by a subsequent version. JMM PUBLISHING LTD reserves the right to modify the Conditions at any time and without prior notice, the versions in force being those accessible when the Order is validated.
For all subscriptions to the Seller's Services, these Conditions take precedence over any other agreement or General Conditions of Purchase issued by JMM PUBLISHING LTD. The Seller may, at its discretion, amend certain clauses of these Conditions or formulate Special Conditions.
These Conditions have been in force since 26 March 2024.
Article 1 - Definitions
For the purposes of these Conditions, the following terms are defined as follows:
"Subscription means the offer contracted by the Customer on the Site, including the corresponding services.
"Customer In accordance with the Consumer Rights Act 2022, means an individual acting outside his or her trade, craft or profession.
"Customer account refers to the space dedicated to the Customer on the Site, where they can (i) access their invoices, (ii) modify their personal data, (iii) consult the results of their analyses.
"GENERAL TERMS AND CONDITIONS OF SALE or "Conditions" refer to this document.
"Order indicates any order placed by a Customer on the Site.
"Services represents the services offered by the Site.
"Site is the term used to designate the website https://cnvrt1.com/ operated by the Seller.
"Rates corresponds to the Subscription prices communicated to Customers on the Site prior to any order confirmation.
"User refers to any person using the Site.
The terms Customer, User and Seller may be referred to individually as a "Party" and collectively as the "Parties".
Article 2 - Description of services
### 2.1 General provisions
The Services offered for sale on the Site are those detailed and accurately presented on the Site. Despite the accuracy of the representation of the Services, the Seller accepts no responsibility for any errors or omissions in the description. The images of the Services are illustrative and are not contractual.
### 2.2 Pre-contract information
Prior to any transaction, the Customer acknowledges having been clearly informed of the Terms and Conditions and of all the information listed in Schedule 3 of the Consumer Rights Act 2022, including in particular:
- The essential characteristics of the products and services,
- The total price of the products or services,
- In the case of a subscription, the total cost for the billing period.
### 2.3 Services and Products
The Customer may purchase various Products via the Site, the details and specifications of which may be consulted online.
The Site enables Users to take personality tests, either by creating a customer account or via guest access.
To obtain the results after completing the questionnaire, the Customer must pay for the service.
The results of the IQ test are sent to the Customer by e-mail.
It is crucial that the Customer answers the personality questionnaire accurately and carefully. No corrections or additional reports will be provided in the event of incorrect or incomplete answers.
### 2.4 Subscription
By subscribing to an IQ Test (article 2.3), the Customer commits to a Subscription to the Site allowing him/her to carry out an unlimited number of Personality Tests. The results are sent by e-mail and can be accessed via the Customer Account.
Subscription is strictly personal and non-transferable. It is forbidden to share access identifiers with third parties. Any breach of this rule may result in legal proceedings and the immediate termination of the Subscription without notice, with the right to compensation for the Seller.
The Subscription takes effect immediately after the account is created following the order of the first IQ Test, with a 24-hour trial period. The Customer may cancel this Subscription during this period.
Subscriptions are taken out for one month and are renewed automatically. The Customer may cancel the Subscription at any time using the "Unsubscribe" option, and the Subscription will expire at the end of the current month.
### 2.5 Creating a Customer Account
To purchase Services, the User may create a customer account or place an order as a "Guest". As soon as a Customer orders an IQ Test, an account is automatically created for them.
When creating an account, the Customer will be asked to provide login details and a password. The Client is responsible for the security of these identifiers and must immediately notify JMM PUBLISHING LTD in the event of loss, theft or suspicious use of their account.
The identifiers are for personal use only. The Seller declines all responsibility in the event of loss or theft of identifiers or fraudulent use of the account.
Article 3 - Order procedure
### How to order on the Site
To place an order, the User must follow the steps explained below:
#### 3.1 Ordering an IQ Test
For more information about ordering an IQ Test, please see article 2.
#### 3.2 Contact information
The Customer must provide personal information such as surname, first name and e-mail address in order to receive the results. They may also opt to receive communications from the Seller by selecting the appropriate option.
#### 3.3 Regulations
The Seller may offer discounts or promotions on the Services. The final price reflects all applicable discounts. These advantages are not cumulative and are valid only once per Customer.
#### 3.4 Confirmation
Before proceeding with payment, the Customer must explicitly accept the Terms and Conditions by ticking the appropriate box. This step also includes the waiver of the right of withdrawal specific to the IQ Test. By validating, the Customer fully accepts the Conditions. Any order placed commits the Customer to accepting the prices and descriptions of the Services offered. Once payment has been made, a sales contract is established between the Customer and the Vendor.
Article 4 - Order management
The Vendor reserves the right to suspend the processing of any order and the supply of Services in the event of refusal to authorise payment by the accredited banking bodies or in the event of non-payment.
Article 5 - Conditions of sale
#### 5.1 Pricing
The Seller may revise its prices at any time, but undertakes to apply the prices indicated when the order is taken, subject to availability of the items on that date.
#### 5.2 Payment incidents
In the event of late payment, all sums due become immediately payable. Late payment penalties, calculated on the amount exclusive of VAT and equivalent to three times the legal interest rate, will be automatically applied without prior notification from the day after the due date.
For Professional Customers, in accordance with Directive 2011/7/EU, in the event of late payment, the Seller may also claim a flat-rate indemnity of €40.00 for collection costs.
The Seller may suspend any order in progress, whatever its stage, in the event of late payment.
#### 5.3 Cancellation and modification
Once validated and paid for, no order may be modified or cancelled, except in the cases permitted by the right of withdrawal (Article 6) and the cancellation of the Subscription (Article 2.4).
Article 6 - Right of withdrawal and exceptions
#### 6.1 Specific features of the IQ Test
According to Article 111 of Chapter 5 of the Consumer Rights Act 2022, the right of withdrawal does not apply in certain specific cases, in particular:
- a) A service provided entirely with the prior agreement of the consumer, who has also acknowledged that he will lose his right of withdrawal once the service has been fully rendered.
- c) A contract for a digital service paid for by the consumer, where :
- i. The digital service has been provided in full.
- ii. The service began with the prior agreement of the consumer, who was aware that he would waive his right of withdrawal once the service had been fully performed.
When ordering an IQ Test, the Customer accepts that the service will begin immediately after payment, allowing access to the digital content (IQ Test results). Consequently, they expressly waive their right of withdrawal.
#### 6.2 Subscription-specific features
In accordance with Article 113.2, the customer has a period of fourteen days in which to exercise their right of withdrawal without giving any reason, subject to the conditions of Article 112.2.d. This right is cancelled as soon as the customer completes at least one IQ Test as part of their subscription, with the exception of the initial Test.
In the event of a valid withdrawal, a full refund will be made within fourteen days of notification, by the same means of payment used at the time of purchase.

Article 7 - Responsibilities and exemptions
#### 7.1 General responsibilities
- Accuracy of information: The Customer undertakes to provide accurate and up-to-date information when placing an order. It is the Customer's responsibility to ensure that the information in their personal space is correct and complete. The Customer is responsible for updating this information.
- Legal capacity: The Customer must be a natural person of full age and legally capable.
- Exemption from liability: The Seller is not liable for the consequences of incorrect or incomplete information provided by the Customer. Similarly, the Vendor is exempt from liability for service interruptions described in articles 4 to 8 of these Conditions.
#### 7.2 Liability waiver
- Nature of the Tests: The personality tests are provided for information purposes only and should not be considered as precise scientific analyses.
- Use of results: The results are provided for information purposes and should not be used as the sole basis for important decisions. Professional advice should be sought for decisions requiring psychological expertise.
- Responsibility for decisions : The Customer is entirely responsible for the decisions made on the basis of the results obtained. The Seller declines all responsibility for the consequences of these decisions.
These clauses are intended to clarify the services provided and define the limits of liability, emphasising the importance of careful use of the information obtained.
Article 8 - Protection of personal data
The Seller's commitments regarding the protection of the Customer's personal data are specified in the "Protection of Personal Data" section on the Site.
Article 9 - Force majeure
The Seller shall not be liable for any delay or failure to fulfil its obligations resulting from circumstances beyond its control or from force majeure, unforeseeable at the time of the order and the effects of which cannot be avoided by appropriate measures.
In the event of force majeure, the application of these Conditions is suspended until the situation is resolved.
If the force majeure persists beyond thirty (30) days, the parties must consult to adjust the terms of the affected order.
The periods mentioned in the Terms and Conditions shall be adjusted in proportion to the duration of the case of force majeure.
Article 10 - Applicable law and dispute resolution
10.1 Conflict management
These Terms and the transactions governed by them are governed by English law.
The parties undertake to resolve any dispute relating to these conditions amicably. The party initiating mediation must inform the other party by registered letter, specifying the problems or breaches observed.
This mediation is compulsory before any legal action is taken. Any action brought without a prior attempt at amicable resolution will be considered inadmissible.
If mediation fails within thirty (30) days, the parties are free to take legal action.
In the absence of agreement, disputes will be settled by the competent courts located near the Seller's registered office.
10.2 Mediation
The European Commission offers an online platform for non-contentious dispute resolution, accessible via https://webgate.ec.europa.eu/odr/. This platform provides an alternative means of settling disputes between consumers and professionals within the EU.
The procedure is free of charge, but the Customer may, at his own expense, be represented by a third party during the mediation.

Article 11 - General provisions
### 11.1 Entire agreement
These Conditions constitute the entire agreement between the Seller and the Customer. They cancel and replace any previous agreement or arrangement.
### 11.2 Nullity
If any provision of these Conditions is declared null and void or inapplicable by a competent court, this nullity or inapplicability will not affect the other provisions, which will remain in force.
### 11.3 Waiver
The failure of either Party to exercise any right or provision of these Conditions shall not constitute a waiver of such right or provision.
### 11.4 Proof
The Parties agree that the Seller's computer records constitute valid proof of the transactions carried out.
### 11.5 Securities
The section titles are included for convenience only and do not affect the meaning or interpretation of the provisions hereof.
### 11.6 Language
These Conditions are written in English. In the event of translation into another language, the English version shall prevail.
### 11.7 Modifications
The Seller reserves the right to modify these Conditions at any time. Any modification will be notified on the Site and will take effect immediately upon publication. Customers are invited to consult the Conditions regularly to remain informed of any updates.
